The ENDS Chinese Vapes Act of 2026 amends the Tariff Act of 1930 to establish escalating civil penalties for the fraudulent, grossly negligent, or negligent entry of unauthorized electronic nicotine delivery systems into the U.S. customs territory. The penalties range from $500 to $5,000 per unit, depending on the severity of the violation. The act also allows for penalties to double if the entry involved transshipment through a third country to evade customs laws. The penalties can triple for repeat offenders within a three-year period and can be increased fivefold if both conditions apply.
