The We Can't Wait Act of 2026 allows disabled individuals to elect to receive disability insurance benefits during the waiting period.

The We Can't Wait Act of 2026 amends title II of the Social Security Act to permit disabled individuals to elect to receive disability insurance benefits during the waiting period. The bill requires the Commissioner of Social Security to update application forms to include an option for this election and to provide information about the election on a public website. The Chief Actuary must calculate the fiscal impact of this election on the Disability Insurance Trust Fund and report to Congress. The Commissioner may choose not to certify the calculated percentage if it is less than 91 percent.
