The Essential Caregivers Act of 2025 amends titles XVIII and XIX of the Social Security Act to mandate that skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and inpatient rehabilitation facilities allow essential caregivers access during periods when regular visitation is restricted. Essential caregivers must be designated by or on behalf of the resident and must follow safety protocols. Facilities may deny access for up to 14 days if approved by the state health department.
