The ERASER Act requires federal agencies to repeal three existing regulations before issuing a new one, with exceptions for certain types of rules.
The Expediting Reform And Stopping Excess Regulations Act, or ERASER Act, mandates that federal agencies must repeal three existing regulations before issuing a new one. This requirement applies to any rule or major rule that imposes a cost or responsibility on a nongovernmental person or a state or local government. It does not apply to rules related to agency management, organization, or personnel, or procurement by the agency. For major rules, the cost of the new rule must be less than or equal to the cost of the rules repealed.
