The MERIT Act requires the reinstatement of recently terminated probationary Federal employees and provides for payments to affected employees.
The MERIT Act, or Model Employee Reinstatement for Ill-advised Termination Act, mandates the reinstatement of affected probationary employees who were involuntarily or voluntarily separated from their Federal positions as part of mass terminations. These employees are entitled to either a reinstatement to a similar position or a payment equivalent to their lost earnings. The Act also requires the Director of the Office of Personnel Management to determine the pay for affected employees' positions and mandates reports on mass terminations and the reinstatement process.
