Social Security Overpayment Relief Act limits recovery of overpayments to 10 years.
The Social Security Overpayment Relief Act amends the Social Security Act to limit the recovery of overpayments under titles II and XVI to a 10-year period. This means that if an individual has received more than the correct amount of payment, the United States cannot recover that overpayment if it occurred more than 10 years prior to the date the Commissioner finds the overpayment. This applies to both Old-Age, Survivors, and Disability Insurance (OASDI) and Supplemental Security Income (SSI) programs.
