Overview

The STOP Resolution (Stop Telling other People Resolution) establishes a mandatory counterintelligence and classified information protection training program for Members, officers, and employees of the House of Representatives who have access to classified information. The resolution addresses national security concerns by ensuring that individuals handling sensitive information receive standardized training in protecting classified materials and recognizing counterintelligence threats. This measure applies to Members who receive classified access through their service, as well as officers and employees holding security clearances, including fellowship participants and federal detailees. The training requirement recurs each Congress, creating an ongoing obligation to maintain current knowledge of classified information handling procedures and counterintelligence awareness.

Core Provisions

The resolution creates a comprehensive training framework administered by the Committee on House Administration under Section 2. The Committee must issue implementing regulations within 90 days of the resolution's adoption. Covered individuals include Members receiving classified access through their service, officers and employees with security clearances who access classified information, fellowship program participants, and detailees from other federal offices. The training must be completed within 90 days after the Committee certifies the program is operational for each Congress, or within 90 days of an individual first becoming a Member, officer, or employee. The resolution provides flexibility through alternative deadlines for fellowship participants and individuals joining near the end of a Congress. An important exception exempts individuals who completed the training during new Member orientation prior to the beginning of a Congress from repeating it during that same Congress. The resolution imposes strict access restrictions tied to training compliance: Members cannot access classified information until they complete training and file a certificate of completion, while officers and employees face a 180-day waiting period after completing training and filing their certificate before receiving classified access.

Key Points

• Training program administered by Committee on House Administration with regulations due within 90 days of adoption [§2(a)]
• Covered individuals: Members with classified access, officers/employees with security clearances, fellowship participants, and federal detailees [§2(b)]
• Standard completion deadline: 90 days after program certification or 90 days after becoming a Member/officer/employee [§2(a)]
• Exception for training completed during new Member orientation [§2(a)(3)]
• Members prohibited from classified access until training completion and certificate filing [§2(d)(1)]
• Officers/employees face 180-day waiting period after training completion before classified access [§2(d)(2)]

Implementation

The Committee on House Administration bears sole responsibility for implementing and administering the training program. The Committee must develop and issue comprehensive regulations within 90 days of the resolution's adoption, establishing the operational framework for the training program. These regulations must address alternative deadlines for special circumstances, including fellowship participants and late-arriving Members or staff. The Committee is specifically directed to consider additional compliance mechanisms beyond the basic training requirement, suggesting an ongoing role in monitoring and enforcement. The Sergeant-at-Arms of the House appears to play a supporting role in implementation, though specific responsibilities are not detailed in the provided text. Compliance is enforced through a certificate filing system, where individuals must document their training completion. The access prohibition mechanism serves as the primary enforcement tool, creating a direct consequence for noncompliance by denying classified information access to those who fail to complete training or file required certificates within specified timeframes.

Key Points

• Committee on House Administration: primary implementing authority with regulatory and administrative responsibilities
• 90-day regulatory development deadline from resolution adoption
• Certificate of completion filing system for compliance documentation
• Committee must develop additional compliance mechanisms [§2(e)]
• Access denial serves as primary enforcement mechanism for noncompliance

Impact

The resolution directly affects all Members of the House of Representatives who receive classified access, along with House officers, employees, fellowship participants, and federal detailees holding security clearances. The administrative burden falls primarily on the Committee on House Administration, which must develop training materials, establish delivery mechanisms, track compliance, and maintain certificate records for potentially hundreds of individuals each Congress. Individual Members and staff face time commitments for training completion and administrative requirements for certificate filing. The 180-day waiting period for officers and employees creates a significant operational impact, potentially delaying their ability to perform duties requiring classified access. This extended waiting period may affect office operations and staffing decisions, particularly for new hires or individuals transitioning between positions. The recurring nature of the training requirement each Congress creates ongoing administrative costs and time commitments. The expected outcome is enhanced security awareness and reduced risk of classified information compromise through standardized training and regular reinforcement of counterintelligence principles. The resolution contains no sunset provision, establishing a permanent training requirement that continues indefinitely across future Congresses.

Legal Framework

The resolution operates under the constitutional authority of the House of Representatives to establish its own rules and procedures pursuant to Article I, Section 5 of the Constitution, which grants each chamber the power to determine the rules of its proceedings. The training requirement relates to the Executive Branch's constitutional authority over classified information and national security, creating an intersection between legislative self-governance and executive classification authority. The resolution does not explicitly cite statutory authorities but operates within the framework of existing classified information protection statutes and executive orders governing security clearances and access to classified materials. The regulatory authority delegated to the Committee on House Administration represents an internal House rule-making function rather than administrative law subject to the Administrative Procedure Act. The access prohibition provisions create enforceable obligations within the House's internal operations, though the resolution does not specify judicial review mechanisms. As a House resolution affecting internal procedures, it does not preempt state or local law and operates exclusively within the federal legislative sphere. The certificate filing requirement and compliance mechanisms function as internal administrative procedures not subject to external judicial review, though constitutional challenges regarding separation of powers or Member privileges could theoretically arise.

Critical Issues

The resolution raises potential constitutional concerns regarding the Speech or Debate Clause and whether training requirements and access restrictions improperly burden Members' legislative functions. The 180-day waiting period for officers and employees presents significant implementation challenges, potentially creating operational difficulties for offices requiring immediate classified access for new staff. This extended delay may force offices to restructure responsibilities or delay hiring decisions, creating unintended workforce management complications. The resolution does not specify cost implications, but developing and administering a comprehensive training program for hundreds of individuals each Congress will require substantial resources, including personnel, technology infrastructure, and ongoing program maintenance. The Committee on House Administration faces the challenge of creating training content that remains current with evolving counterintelligence threats while accommodating diverse schedules and learning needs. The alternative deadline provisions for fellowship participants and late-arriving individuals create administrative complexity in tracking multiple compliance timelines. Opposition arguments may focus on the burden imposed on Members' time, the potential for training requirements to be used as a mechanism to restrict access to information, and concerns about the 180-day waiting period creating operational inefficiencies. The lack of specified exemptions for Members with extensive prior intelligence or military experience may be viewed as unnecessarily rigid. The resolution's silence on consequences for the Committee's failure to establish the program within 90 days creates uncertainty about implementation timelines and Member obligations during any delay period.
