The NO FEES Act of 2026 amends the Federal Food, Drug, and Cosmetic Act to redefine the term "small business" for fee waiver purposes as an entity employing fewer than 20 full-time equivalent employees. It mandates that the Secretary of Health and Human Services grant a fee waiver for the annual registration of an establishment if it qualifies as a small business. The waiver covers 100% of the fee for the first three years and 50% for the subsequent two years. Foreign companies are excluded from applying for such waivers.
