The EXCLAVE Act of 2026 amends title 5, United States Code, to require federal agencies to consult with residents of pene-exclaves during rulemaking. A pene-exclave is defined as a region of a state or territory that is generally accessible by land only through a foreign country. If an agency determines or is alerted that a proposed rule may impose a unique burden on pene-exclave residents, it must hold a public meeting for these residents to submit comments, provide notice of the meeting to relevant officials, and record and publish the meeting's content.
