Our Doctors First Act of 2026 prohibits Medicare payments for graduate medical education costs for non-citizen residents.

The Our Doctors First Act of 2026 amends the Social Security Act to prohibit Medicare payments for graduate medical education costs attributable to individuals who are not citizens or nationals of the United States. Effective for cost reporting periods beginning one year after the enactment, hospitals and nonhospital providers that count non-citizen residents for payment purposes will face civil monetary penalties and exclusions from receiving payments. Hospitals face a 10-year exclusion, while nonhospital providers face a 5-year exclusion.
