Increases civil penalties for unauthorized electronic nicotine delivery systems entering the U.S.

The ENDS Chinese Vapes Act of 2026 amends the Tariff Act of 1930 to impose escalating civil penalties for fraudulent, grossly negligent, or negligent entry of unauthorized electronic nicotine delivery systems into the U.S. customs territory. The penalties range from $500 to $5,000 per unit, depending on the severity of the violation. The act defines "unauthorized electronic nicotine delivery system" as any such device not authorized under the Federal Food, Drug, and Cosmetic Act. The maximum penalty for a shipment can be up to 1,000 percent of the estimated retail value in the United States.
