The Fair Air Standards Act amends the Clean Air Act to establish a procedure for redesignating an ozone nonattainment area as an attainment area. This can occur if the state demonstrates to the Environmental Protection Agency (EPA) that the area would have met the national ambient air quality standard for ozone by the applicable attainment date, except for ozone or ozone precursors coming from outside the state. The state governor can submit this finding and demonstration to the EPA at any time. If the EPA concurs, it must promulgate the redesignation within 180 days.
