The Decentralized Access to Technology Alternatives Act of 2026, or DATA Act of 2026, amends the Federal Power Act to exempt consumer-regulated electric utilities from federal regulation. These utilities can operate independently, construct facilities within public rights-of-way, and serve new electric loads not previously served by retail electricity suppliers. They are exempt from Federal Energy Regulatory Commission and Department of Energy regulation, including reliability standards, unless they choose to connect to the bulk-power system.
