The Small Business Dependent Care FSA Opportunity Act amends the Internal Revenue Code to offer a tax credit to eligible small employers for startup costs related to dependent care flexible spending plans. These costs include expenses for establishing or administering the plan and educating employees about it. The credit is available for the first year the plan becomes effective and the two following years. The credit amount is the lesser of $250 per non-highly compensated employee or $5,000, with a maximum of $500 per year.
