The Take Back Our Hospitals Act of 2026 amends title XVIII of the Social Security Act to prohibit payments under Medicare to hospitals or skilled nursing facilities owned or controlled by certain firms. These firms include private equity funds, corporations controlled by private equity funds, and real estate investment trusts. The prohibition takes effect three years after the enactment of this Act for existing facilities. Covered firms or their affiliates found in violation are subject to joint and several liability for any penalties or obligations incurred by the facility.
