Prevents citizens of adversarial foreign nations from entering into or enforcing surrogacy contracts in the United States.

The SAFE KIDS Act aims to prevent citizens of adversarial foreign nations from entering into or enforcing surrogacy contracts in the United States. It voids and makes unenforceable surrogacy agreements between U.S. surrogate parents and prospective parents from foreign entities of concern. It also imposes criminal penalties on surrogacy brokers who facilitate such agreements. Custody of children born under these agreements is determined based on the best interests of the child under the law of the State where the surrogate parent resides.
