A BILL

To authorize the Land Port of Entry Community Infrastructure Program to address deficiencies in community infrastructure supportive of land ports of entry, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Definitions.

In this Act:

community infrastructure.— (1) COMMUNITY INFRASTRUCTURE.—The term “community infrastructure” means a project or facility that—

  1. (A) is—
    1. (i) a transportation project;
    2. (ii) a water, wastewater, telecommunications, electric, gas, or other utility project; or
    3. (iii) any other project directly supporting a land port of entry or infrastructure that is disproportionately impacted by the nearby presence of a land port of entry, as designated by the Secretary;
  2. (B) is—
    1. (i) owned by a State, Tribal, or local government; or
    2. (ii) a not-for-profit, member-owned utility service; and
  3. (C) is—
    1. (i) focused on the modernization of a land port of entry; or
    2. (ii) located within 25 miles of a land port of entry and is supportive of, or disproportionately impacted by the nearby presence of, a land port of entry.

rural area.— (2) RURAL AREA.—The term “rural area” means a city, town, or unincorporated area that has a population of not more than 100,000 inhabitants.

Secretary.— (3) SECRETARY.—The term “Secretary” means the Secretary of Homeland Security.
