No Surprises Act Enforcement Act increases penalties for health plans and issuers violating balance billing requirements.

The No Surprises Act Enforcement Act amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code to increase penalties for group health plans and health insurance issuers that violate balance billing requirements. It specifies that plans or nonparticipating providers or facilities must pay three times the difference if they fail to make required payments on time. The bill also mandates that plans or nonparticipating providers or facilities notify the Secretary of such payments.
