Limits recovery of overpayments for Social Security old-age benefits.
The Protecting Elders From Government Error Act amends title II of the Social Security Act to limit the recovery of overpayments for old-age insurance benefits. It prohibits recovery if the overpayment is related to an old-age insurance benefit, occurred more than six months before the finding, and resulted from an error by the Commissioner. It also limits the withholding of monthly benefits to no more than 5 percent of the amount payable. These changes apply to overpayments outstanding on or after the date of enactment.
