Establishes a premium processing fee for expedited permanent labor certification applications.
The PERM Backlog Reduction Act of 2026 establishes a separate account in the Treasury for fees collected to expedite permanent labor certification applications. Employers can pay a $1,200 fee for faster processing of form ETA–9089, or any successor form. The collected fees will be used for program administration, staffing, training, case adjudication, system upgrades, fraud detection, and other purposes deemed appropriate by the Secretary of Labor. The act ensures that the expedited processing does not affect the standard processing time for other applications.
