These utilities can construct and operate facilities within public rights-of-way, subject to certain requirements. They are exempt from Federal Energy Regulatory Commission and Department of Energy regulation, including reliability standards and other requirements. They can sell electricity at retail to eligible customers, provided their system is physically isolated from regulated utilities and the bulk-power system.
