The STATES Act requires states to reimburse the federal government for deploying the National Guard.
The STATES Act, or States Taking Accountability for Troops Engaged in Safety Act, mandates states to reimburse the federal government for deploying the National Guard. The President must direct the Secretary of Defense to determine the costs incurred by the federal government and reduce funds made available to the state by 100 percent of those costs. The President may waive this reimbursement requirement in cases of extreme financial hardship to the state or when the deployment is primarily to protect federal property or enforce federal law.
