Requires fishways for dams to ensure safe fish passage.
Requires the commissioner to determine if dams need fishways to protect fisheries resources. If a fishway is necessary, the commissioner must issue an order to the dam owner to construct one. Fishways must be kept open and free for fish passage from April 1 to November 1 each year unless the commissioner specifies otherwise. The commissioner must also ensure a safe, timely, and effective fish passage for migratory fish at all life stages upstream and downstream of the dam and associated reservoir.
