West Virginia SB711 aims to protect private property from damage caused by concentrated highway runoff. The bill prohibits the Division of Highways from discharging such runoff onto private property unless it is conveyed to a lawful outfall. A lawful outfall includes natural watercourses, ponds, lakes, public stormwater systems, and properly designed detention or retention facilities. The Division of Highways is authorized to extend or modify drainage facilities beyond the highway right-of-way and to enter private property for sediment removal.
