Limits employer liability for employees with expunged drug addiction-related offenses or diseases.

West Virginia SB35 mandates the creation of a database to record expunged drug addiction-related offenses or diseases. Courts must cross-reference this database in civil or criminal actions involving employees participating in return-to-work initiatives for recovering addicts. Employers are exempt from providing health insurance or covering health care costs for employees with expunged drug addiction-related offenses or diseases if the employee continues to use addictive drugs or substances during employment.
