West Virginia SB245 requires oil and gas operators to file a Declaration of Pooled Unit with the clerk of county commissions within 60 days after drilling permits are issued. The declaration must include details such as the unit's name, API numbers and names of wells, taxing districts, plats, and mineral and surface parcel information. If the declaration is amended, an "Amended Declaration of Pooled Unit" must be filed within 60 days. Lessors or royalty owners can request information from operators and may bring civil actions for non-compliance. The act takes effect 120 days after passage.
