Raylee's Law, established by West Virginia SB116, prohibits the authorization of home instruction if there is a pending child abuse or neglect investigation against a custodial parent or guardian with whom the child resides, or against a person instructing the child. The county superintendent must establish a policy to inform the superintendent when a report of suspected child abuse or neglect is made. Upon receiving such a report, the superintendent must request case status confirmation from the Department of Human Services and substantiate the abuse or neglect complaint.
