The West Virginia Public Defense and Provisioning Act creates an Office of Public Defense within the West Virginia State Police to acquire and sell machine guns to qualified persons. The Office will transfer machine guns to individuals who meet state and federal eligibility criteria. The Office will also establish warehouses and distribution stations for machine gun sales. A $250 surcharge will be added to the price of each machine gun sold, with the proceeds going into a Public Defense Fund. The Office will not be liable for any actions of machine gun transferees.
