Introduced·2/21/26
Intr Text

Clarifies when service of process on a limited liability company or corporation by the Secretary of State is sufficient.

The bill amends the West Virginia Code to clarify the conditions under which service of process on a limited liability company or corporation by the Secretary of State is considered sufficient. It specifies that service is valid if the return receipt is signed by an agent or employee of the company or if the registered or certified mail is refused by the addressee and returned to the Secretary of State. The Secretary of State must then file a copy of the process, notice, or demand and send another copy to the company's registered agent or designated person.
