West Virginia SB1008 amends the statute of limitations for asbestos and silica litigation. It sets the limitation period at 12 years from the date of first sale, lease, or delivery of possession by the manufacturers or 10 years from the date of first sale, lease, or delivery to its initial user, consumer, or other non-seller, whichever period expires earlier. The bill also specifies that a plaintiff cannot bring an action against the manufacturers of mining equipment used underground if the exclusive use of asbestos in the equipment was due to specific requirements under 30 CFR Part 18 or if.
