The Judicial Accountability and Recall Act allows voters to initiate recall elections for judicial officers in West Virginia. The act applies to justices of the Supreme Court, judges of the Intermediate Court of Appeals, circuit court judges, family court judges, and magistrates. A recall petition must be signed by 20% of the voters who participated in the last election for that judicial office. The petition must be filed within specific timeframes depending on the judicial office. If a majority votes in favor of recall, the judge is removed from office.
