West Virginia HB5012 amends the Code of West Virginia to allow for in-year reassignments of school personnel to meet school needs. The superintendent can reassign surplus personnel to another school or grade level within the same school to comply with pupil-teacher ratios, class sizes, or caseload standards. Reassignments can occur without prior notice and a hearing if certain conditions are met. The reassigned employee's annual contract, compensation, and benefits remain unchanged. Employees not provided notice and a hearing opportunity cannot be reassigned.
