West Virginia HB4590 amends the Code of West Virginia to allow private property owners who substantially prevail in eminent domain proceedings to recover reasonable costs and attorney's fees. This applies to both trial and appellate courts. Previously, only the applicant paid the costs of a condemnation proceeding in trial court.
