Relating to restoring local jurisdiction to state political subdivisions over certain electric power facilities.

Introduced·1/19/26
Intr Text

Restores local jurisdiction over certain electric power facilities in West Virginia.

West Virginia HB4509 seeks to restore local jurisdiction over certain electric power facilities by exempting certified microgrid districts and certified high impact data centers from local zoning, building permits, licensing, and other regulations. These facilities must still pay applicable taxes and fees. The Department of Commerce is tasked with assisting these projects and designating a Data Economy Liaison to expedite development. The bill aims to promote uniform application of state law regarding these facilities.
