The bill authorizes the West Virginia Department of Environmental Protection to create rules aimed at controlling annual nitrogen oxides emissions, annual sulfur dioxide emissions, and ozone season nitrogen oxides emissions. These rules are intended to address cross-state air pollution. The legislative rule filed on July 23, 2025, is authorized under the authority of Section 22-5-4 of the West Virginia Code.
