Creating a third-party claimant's right to appraisal under automobile liability insurance policies.

Introduced·3/11/26
Introduced Text

SB6359 establishes a right for third-party claimants to demand appraisal for automobile property damage disputes.

SB6359 creates a statutory right for third-party claimants to demand an appraisal when they and an automobile liability insurer cannot agree on the amount of property damage. This applies to all automobile liability insurance policies issued or renewed on or after January 1, 2027. Either party can request an appraisal, and each party selects an appraiser. If the appraisers cannot agree, an umpire is selected to resolve the dispute. The cost of the appraisers and umpire is shared equally.
