This bill establishes liability standards for state legislators who vote for laws that make it easier for individuals accused of violent crimes to obtain pretrial release or evade reasonable criminal prosecution. If a person is injured by an individual released from custody or not prosecuted due to such a law, they can sue the legislator who voted in favor of the law. The legislator can be held personally liable for costs of defense and judgment if it is found they failed to adequately consider the risks of public harm. The bill takes effect January 1, 2026.
