Virginia HB1078 amends the Virginia Residential Landlord and Tenant Act to protect prospective tenants from adverse actions by landlords.

Virginia HB1078 prohibits landlords from taking adverse actions against prospective tenants based on dismissed or nonsuited unlawful detainer cases or cases eligible for expungement. Adverse actions include denying rental applications, increasing security deposits or rent, or imposing more restrictive lease terms. Landlords are also restricted from photocopying U.S. government-issued identification unless necessary for background checks. If a landlord violates these provisions, the prospective tenant can recover application fees, statutory damages, and attorney fees.
