The Commissioner of Mental Health must notify the victim, State's Attorney, and Attorney General of the pending discharge. Victims can request a hearing in the Family Division of the Superior Court within 10 days of the notice. The discharge is stayed until the hearing concludes, with any subsequent order issued no later than five days after the hearing.
