Utah SB0105 amends the defense of justification when using force in defense of person or property. It removes the actor's ability to claim the defense if charged with recklessly, or with criminal negligence, causing injury or death to an innocent individual while using force justified against a different individual. The bill also modifies pretrial justification hearing procedures to deny the hearing to defendants charged with recklessly causing injury or death to another individual.
