Texas SB814 mandates automatic nondisclosure orders for certain misdemeanor defendants' criminal history records post-deferred adjudication community.
Texas SB814 amends the Code of Criminal Procedure to automatically order nondisclosure of criminal history records for certain misdemeanor defendants who successfully complete a period of deferred adjudication community supervision. This applies to those placed on supervision for a misdemeanor other than a traffic offense punishable by fine only, and who meet specific criteria, including a dismissal and discharge under Article 42A.111 after January 1, 1993. The Texas Department of Public Safety must identify eligible individuals and notify them of their entitlement to such orders.
