SB464 amends the Health and Safety Code to allow county commissioners courts and municipal governing bodies to prohibit e-cigarette retailers from operating within 300 feet of public or private primary or secondary school campuses. This prohibition does not apply to retailers whose gross receipts from e-cigarette sales are less than 50% of their total gross receipts. The act takes effect immediately if approved by two-thirds of the members in both legislative houses; otherwise, it takes effect September 1, 2025.
