SB2978 amends Section 542A.003 of the Texas Insurance Code by adding a new subsection (b-1). This amendment mandates that the amount of money a claimant alleges is owed by the insurer on a property damage claim must be the amount the claimant will accept in full payment. Payment of this amount by the insurer within the specified period settles and resolves the claim. The changes apply only to actions commenced after the effective date of this Act. If the Act receives a two-thirds vote in both houses, it takes effect immediately; otherwise, it takes effect September 1, 2025.
