Texas SB2874 amends the definition of conservation easement in the Natural Resources Code. It specifies that a conservation easement is a nonpossessory interest in real property that imposes limitations or affirmative obligations to retain or protect natural, scenic, or open-space values, protect natural resources, maintain or enhance air or water quality, preserve historical, architectural, archeological, or cultural aspects, or protect living things from excessive artificial light. The changes take effect September 1, 2025.
