Texas SB2739 amends the Penal Code by adding a subsection that defines unreasonable noise near a private residence. A noise is presumed unreasonable if it exceeds a decibel level of 85 after a person receives notice from a magistrate or peace officer that the noise is a public nuisance. Additionally, a noise is presumed unreasonable if it exceeds a decibel level of 58 or causes vibrations at a private residence within 30 feet from the property line. This Act takes effect September 1, 2025.
