Texas SB2399 amends the Business & Commerce Code to restrict the sale of obscene devices. A business may not sell, offer for sale, or hold for sale an obscene device unless it is a sexually oriented business operating in accordance with Chapter 102. County or district attorneys may seek injunctions and civil penalties of up to $5,000 per violation, along with reimbursement for investigation and prosecution costs. The act takes effect immediately if passed by a two-thirds vote in both houses, otherwise it takes effect September 1, 2025.
