Texas SB2385 amends the definition of "residential subdivision" in the Transportation Code. It specifies that a residential subdivision is located in a county with a population greater than 220,000 or less than 75,000 that is adjacent to three counties with populations of more than 450,000. Additionally, it must have a plat recorded in the county real property records and the majority of lots must be subject to deed restrictions limiting the lots to residential use. This Act takes effect September 1, 2025.
