Texas SB2161 amends the Water Code to allow the recovery of reasonable expenses incurred by a retail public utility in the appeal proceedings of water or sewer service rates. The utility commission may establish the effective date for the rates at the original effective date proposed by the service provider and may order refunds or allow a surcharge to recover lost revenues. Prevailing parties in proceedings for review of a governing body decision may recover reasonable fees for attorneys and expert witnesses. The changes apply to appeals filed on or after the effective date of the Act.
