Texas SB2027 limits mental anguish damages for mishandling of bodies by funeral service providers.

Texas SB2027 amends the Civil Practice and Remedies Code to establish a new chapter governing funeral service providers' liability for mental anguish damages. The bill applies to actions brought by individuals with a special relationship to the deceased, such as rights of sepulcher or possession of the body. Funeral service providers are not liable for mental anguish damages unless the claimant proves mishandling of the body or remains, the mishandling was not consistent with common practice, the mishandling caused significant emotional harm, and the provider should have foreseen the harm.
