Texas SB1937 amends the Code of Criminal Procedure to require nuclear DNA testing of biological evidence in capital cases. The state must require either the Department of Public Safety or an accredited laboratory to perform the testing. The laboratory performing the testing must pay for all nuclear DNA testing. The court must order the state, a subject matter expert, and the defendant to meet and confer about which biological materials collected as part of an investigation of the offense qualify as biological evidence that is required to be tested.
